Image Rules?

I don't know what the rules are for uploading an image to a Bio. Can this this flickr photo be used here? flinc 09:46, 4 February 2009 (PST)

I don't think that photo could work as under "Additional Information" it says "All rights reserved", meaning it's not under a free license. Many pictures on Flickr are under a Creative Commons license, but unfortunately this is not another one.
